The Federal Government brought this action on behalf of the Red Bank Band under section 31 of the Indian Act, R.S.C. 1970, c. I-6 for possession of lands located within a reserve and occupied by the Appellant. The lands in question were surrendered by the Band to be sold. The proceeds were to be paid to the Band, but the land was never sold. The Appellant claimed title to the land on the basis of adverse possession. This document is the factum of the Appellant.
