Description
Aboriginal Legal Services of Toronto argues that s. 638(1)(b) of the Criminal code was not adequately considered by the Trial Judge. The failure to consider the changing social concerns and values inherent in the Charter denied the accused a fair trial under ss. 7 and 11.
